TERMS OF SERVICE
Last updated April 2026Welcome to PIE Parking. These Terms of Service ("Terms") constitute a legally binding agreement between you and PIE Parking (Pty) Ltd ("PIE," "we," "us," or "our"). These Terms govern your access to and use of our ticketless parking mobile application, related websites, IoT gate control hardware, and underlying software infrastructure (collectively, the "Services").
PLEASE READ THESE TERMS CAREFULLY. IN ACCORDANCE WITH SECTION 49 OF THE SOUTH AFRICAN CONSUMER PROTECTION ACT (CPA), CLAUSES THAT LIMIT OUR LIABILITY, REQUIRE YOU TO INDEMNIFY US, OR ACKNOWLEDGE A FACT ARE HIGHLIGHTED IN BOLD TEXT. BY USING THE SERVICES, YOU ACKNOWLEDGE AND AGREE TO THESE TERMS.
1. THE DUAL NATURE OF OUR SERVICES
PIE Parking provides a platform that connects parking facility operators with individuals seeking parking. Because our Services cater to two distinct groups, certain terms apply specifically depending on your role:
- End Users: Individuals who download the PIE Parking mobile application to access ticketless parking facilities.
- Facility Operators: Owners, managers, or authorized operators of parking garages who have entered into an agreement with us to install PIE IoT Hardware and utilize our platform to manage parking access and collect fees.
2. TERMS APPLICABLE TO END USERS
2.1. Account Registration and Use
To use the PIE app, you must register for an account, providing accurate and current information. You are strictly responsible for maintaining the confidentiality of your login credentials. You must be at least 18 years old to create an account.
2.2. Parking Access and IoT Triggers
The app requires access to your mobile device's Bluetooth and Location services to authenticate your presence and trigger the IoT gate controllers. You acknowledge that failure to grant these permissions or poor network connectivity on your device may prevent you from entering or exiting a Parking Facility. PIE is not liable for delays or associated costs resulting from device-side failures.
2.3. Payments and Billing
When you use a PIE-enabled Parking Facility, you agree to pay the parking tariffs set by the Facility Operator. All payments and payment details are handled explicitly and securely by our third-party payment gateway, Payfast. PIE does not directly store, process, or interact with any of your payment information. By adding a payment method, you authorize the secure processing of charges for the duration of your parking session upon exiting the facility via Payfast.
2.4. Assumption of Risk
PIE PARKING ONLY PROVIDES THE ACCESS CONTROL AND PAYMENT TECHNOLOGY. WE DO NOT OWN, OPERATE, OR SECURE THE PARKING FACILITIES. YOU AGREE THAT PARKING YOUR VEHICLE AT ANY PIE-ENABLED FACILITY IS DONE ENTIRELY AT YOUR OWN RISK. PIE PARKING (PTY) LTD SHALL NOT BE HELD LIABLE FOR ANY LOSS, THEFT, DAMAGE TO YOUR VEHICLE, OR PERSONAL INJURY SUSTAINED WHILE IN A PARKING FACILITY.
3. TERMS APPLICABLE TO FACILITY OPERATORS
3.1. Hardware Installation and Maintenance
Facility Operators agree to allow PIE to install IoT gate controllers and associated hardware at their premises. The Facility Operator is responsible for providing a stable power supply and protecting the hardware from physical vandalism. Maintenance of the PIE Hardware will be conducted as per the specific Service Level Agreement (SLA) signed between the Operator and PIE.
3.2. Fee Collection and Disbursements
PIE will collect parking fees from End Users on behalf of the Facility Operator. We will disburse these funds to the Facility Operator on the agreed-upon rolling schedule, minus PIE's service/commission fees and applicable third-party transaction costs. PIE reserves the right to withhold payouts if fraudulent activity is suspected.
3.3. Facility Responsibilities
The Facility Operator retains sole responsibility for the safety, security, and maintenance of the physical parking facility. The Operator indemnifies PIE Parking against any claims made by End Users regarding vehicle damage, theft, or injury occurring on the premises.
4. SYSTEM INTEGRITY AND PROHIBITED CONDUCT
Whether you are an End User or Facility Operator, you agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the PIE app or firmware.
- Spoof Bluetooth signals, GPS locations, or use digital emulators to bypass gate controllers or avoid parking fees.
- Tamper with, physically damage, or disconnect PIE IoT Hardware at any facility.
Violation of these terms will result in immediate account termination, potential hardware removal, and civil or criminal prosecution.
5. PRIVACY AND DATA PROTECTION
Your use of the Services is also governed by our Privacy Policy, which details how we collect, use, and protect your personal information in compliance with the Protection of Personal Information Act (POPIA). Please review our Privacy Policy to understand our data practices.
6. LIMITATION OF LIABILITY AND WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, PIE PARKING PROVIDES THE SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING UPTIME GUARANTEES (EXCEPT AS EXPLICITLY STATED IN A B2B SLA). PIE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES.
7. TERMINATION
We may suspend or terminate your access to the Services at our sole discretion, without notice, if you breach these Terms. End Users may terminate this agreement by deleting their account and the app. Facility Operators must adhere to the termination clauses set forth in their specific commercial SLA regarding hardware retrieval.
8. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the South African courts.
